Terms and Conditions For Jaytech Plumbing

Welcome to Jaytech Plumbing Ltd. These Terms and Conditions ("Terms") govern your use of our plumbing services, website, and any related interactions with our business. By engaging our services or accessing our website, you agree to be bound by these Terms. Please read them carefully.

1. Services Provided

Jaytech Plumbing provides professional plumbing services, including but not limited to:

  • Installation, repair, and maintenance of plumbing systems.

  • Emergency plumbing services.

  • Drain cleaning and pipe inspections.

  • Fixture installations (e.g., faucets, toilets, water softeners).

All services are subject to availability, scheduling, and agreement on scope and pricing. We reserve the right to refuse service at our discretion, in accordance with applicable laws.

2. Service Agreements and Quotes

  • Quotes: We provide estimates or quotes based on the information you provide. Final costs may vary due to unforeseen issues discovered during service (e.g., hidden pipe damage). Any changes to the scope of work will be communicated and agreed upon before proceeding.

  • Service Agreements: For certain services, a written agreement or contract may be required. Verbal agreements for smaller jobs are binding once work begins.

  • Cancellations: You may cancel a scheduled service at least 6 hours in advance without charge. Late cancellations or no-shows may incur a fee of $50.

3. Pricing and Payment

  • Pricing: Service fees are based on labor, materials, and any applicable taxes. Prices are provided in quotes or agreed upon before work begins.

  • Payment Terms: Payment is due upon completion of services unless otherwise agreed. We accept cash, credit/debit cards, electronic transfers, and cheques. Late payments may incur a fee of 1.5% per month.

  • Deposits: For large projects, a deposit of 30% may be required before work begins. Deposits are non-refundable unless we fail to perform the agreed services.

4. Customer Responsibilities

You agree to:

  • Provide accurate information about your plumbing issue and property conditions.

  • Ensure safe and clear access to the service area (e.g., removing obstacles, securing pets).

  • Obtain necessary permits or approvals for work, if required (we can assist upon request).

  • Notify us of any hazardous conditions (e.g., asbestos, mold) before work begins.

Failure to meet these responsibilities may result in delays, additional costs, or cancellation of services.

5. Warranties and Guarantees

Standard 2 Year Warranty

  • Coverage Scope: This 2 year warranty applies exclusively to the specific plumbing components, systems, or installations directly serviced or installed by Jaytech Plumbing Ltd. It does not extend to any other parts of the plumbing system or components not addressed in our service or installation.

  • Soft Water Requirement: To maintain the validity of this warranty, the household must utilize a functioning water softener system to ensure soft water conditions. Hard water can damage plumbing components, and failure to maintain soft water may void the warranty.

  • Exclusions for Regular Maintenance: This warranty does not cover routine maintenance items, including but not limited to filters, seals, or other consumable components that require periodic replacement as part of normal upkeep.

  • Drain Cleaning Warranty Conditions: Drain cleaning services are subject to separate warranty terms, which will be provided at the time of service. The 2-year warranty does not apply to drain cleaning unless explicitly stated in the service agreement.

  • Transferability: This warranty is transferable to the subsequent homeowner of the property where the original service or installation was performed, provided that all warranty conditions, including the soft water requirement, continue to be met. Notification of transfer must be provided to Jaytech Plumbing Ltd in writing within 30 days of the property sale.

  • Limitation of Liability: Jaytech Plumbing Ltd. is not responsible for any damage to the property, including but not limited to water damage, structural damage, or damage to personal belongings, resulting from plumbing leaks or failures, whether related to the warranted work or otherwise.

  • General Conditions:

    • The warranty is valid for two (2) years from the date of service or installation completion.

    • Any modifications, repairs, or alterations to the covered work performed by anyone other than Jaytech Plumbing Ltd will void the warranty.

    • Jaytech Plumbing Ltd reserves the right to inspect the system to verify compliance with warranty conditions before honoring any claims.

    • Claims under this warranty must be submitted in writing to Jaytech Plumbing Ltd with proof of service and details of the issue.

6. Liability and Limitations

  • Limitation of Liability: To the fullest extent permitted by law, Jaytech Plumbing Ltd is not liable for indirect, incidental, or consequential damages (e.g., property damage, loss of use) arising from our services, except where caused by our gross negligence or wilful misconduct.

  • Property Damage: We take reasonable care to avoid damage to your property. Pre-existing conditions or unavoidable damage (e.g., accessing pipes behind walls) are not our responsibility unless caused by our negligence.

  • Emergency Services: In emergencies, we may take immediate action to mitigate damage (e.g., shutting off water). You agree to indemnify us for reasonable actions taken in good faith.

7. Termination of Services

We may terminate or suspend services if:

  • You fail to make payments as agreed.

  • You provide false or misleading information.

  • Conditions at the service site pose a safety hazard to our staff.

  • You breach these Terms.

Upon termination, you remain responsible for payment for services rendered.

8. Intellectual Property

All content on our website, including logos, designs, and text, is the property of Jaytech Plumbing Ltd or its licensors. You may not use, reproduce, or distribute our content without prior written permission.

9. Force Majeure

We are not liable for delays or failure to perform services due to events beyond our control, including but not limited to natural disasters, strikes, supply shortages, or government restrictions.

10. SMS/Text Messages

Jaytech Alerts

  • By opting into "Jaytech Alerts", you agree to receive recurring automated text messages from Jaytech Plumbing, including appointment reminders, service updates, emergency plumbing alerts, and occasional promotional offers. Messages may include confirmations for scheduled services, notifications about technician arrivals, urgent alerts for plumbing issues, and special discounts on maintenance or repairs.

  • You can cancel the SMS service at any time. Simply text "STOP" to the shortcode. Upon sending "STOP", we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us. To rejoin, sign up as you did initially, and we will resume sending SMS messages to you.

  • If you experience issues with the messaging program, reply with the keyword HELP for more assistance, or reach out directly to [email protected].

  • Carriers are not liable for delayed or undelivered messages.

  • As always, message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies. For questions about your text plan or data plan, contact your wireless provider.

11. Dispute Resolution

  • Negotiation: Any disputes arising from these Terms or our services will first be addressed through good-faith negotiation.

  • Governing Law: These Terms are governed by the laws of Ontario, Canada. Any legal action must be brought in the courts of the Ontario Court of Justice.

12. Changes to These Terms

We may update these Terms to reflect changes in our practices or legal requirements. The updated Terms will be posted on our website with a revised effective date. Continued use of our services after changes constitutes acceptance of the new Terms.
